The course aims to familiarise advocates with the legal interface between the Care Act and the National Framework for NHS Continuing Health Care status. The course covers:
• The difference between individuals’ legal rights to care and the NHS’s obligations regarding the provision of health services.
• The relevance of the concept of a primary health need for funding obligations, for the use of advocates supporting either assessment or a decision support tool exercise after assessments.
• Key concepts in CHC process – the relevance of consent to assessment, the ‘line’ and why it’s not possible to draw a firm one; checklisting; fast track rights; reviews vs revisions etc.
• The rules that apply to CHC care planning once a person has been found eligible for the status.
• Typical ‘wrong turns’ taken in the progress towards a decision about someone’s status and what advocates should do about them.
